Importers, distributors seek declaratory judgment against outsourcing company

SHERMAN — Texas Importers and distributors are suing an outsourcing company, alleging wrongful filing of an arbitration notice.

Omnipart USA LLC and OmniMax USA LLC filed a lawsuit Dec. 8 in the Sherman Division of the Eastern District of Texas against Interpart Worldwide LLC alleging wrongfully filed an arbitration notice regarding property in Anna, Texas.

According to the complaint, unless arbitration is enjoined, one or both plaintiffs will be forced to defend against Interpart's claim of arbitration and will incur substantial expenses in defending themselves. 

The plaintiffs allege Interpart Worldwide filed an arbitration notice upon a purported breach of representation agreement wherein neither of the plaintiffs was a party to or legally bound to such an agreement.

Ominpart USA and OmniMax USA seek trial by jury, declaration judgment that neither of the plaintiffs is legally bound to the arbitration and that neither breached the representation agreement, plus attorney fees, costs of court and all other necessary relief. They are represented by attorney Thomas G. Haskins, Jr. of Barnes & Thornburg LLP in Dallas.
