Used car dealership alleges customer owes more than $25,000

GALVESTON — A used car dealership is suing a customer, alleging breach of agreement in failing to pay more than $25,000.

Jimmy Roberts, individually and doing business as City Auto Sales, filed a lawsuit Dec. 14 in Galveston County District Court against Noe Martinez, individually and doing business as Santa Fe Autoplex LLC, alleging failure to perform contractual obligations.

According to the complaint, Roberts financed more than a dozen motor vehicles for the defendants' used car sales lots. To date, the principal amount of of $25,377 remains uncollected, the suit says. 

The plaintiffs allege the defendants wrote hot or insufficient funds checks for three vehicles that City Auto Sales provided and failed to make payments on the principal balance due.

City Auto Sales seeks trial by jury, judgment for $25,377, pre- and post-judgment interest, $15,000 as reasonable attorney fees, costs of court and all proper relief. It is represented by attorney Paul H. LaValle of Law Offices of Paul Houston LaValle & Associates PC in Texas City.
