Visitor blames Texas City hospital for elevator injuries

GALVESTON — A Texas City man is suing a local hospital and two elevator companies, alleging their negligence caused the plaintiff to be injured in an elevator. 

Kirby D. Mitchell filed a lawsuit Dec. 15 in Galveston County District Court against Mainland Medical Center, Schindler Elevator Corp. and Otis Elevator Co., alleging they failed to exercise reasonable care in the operation and/or maintenance of the elevator.

According to the complaint, on Dec. 28, 2014, Mitchell was visiting his uncle at Mainland Medical Center in Texas City and was using the elevator. The suit says the elevator door slammed on his left shoulder, which led to surgery. 

As a result, the lawsuit states, Mitchell has suffered medical expenses, loss of earning capacity, physical pain, suffering and mental anguish. The plaintiff alleges the defendants failed to properly maintain and inspect the elevator and negligently operated a defective elevator.

Mitchell seeks trial by jury, monetary relief of more than $1 million, interest and all other equitable relief. He is represented by attorney Scott R. Crivelli of The Carlson Law Firm PC in Killeen.
