Harris Co. claims subdivision detention pond constructed without permit

HOUSTON - Claiming that Pedraza Ventures, LLC is in violation of its Floodplain Management Regulations, Harris County has pursued legal action.

A lawsuit filed Jan. 11 in the Harris County 189th District Court faults Pedraza for constructing a detention pond in the Magnolia Gardens subdivision without a Class I Development Permit.

Per the original petition, development on the property requires the permit because it is located above the Base Flood Elevation.

In summer 2015, the plaintiff's engineering department conducted two investigations which determined that the defendant failed to secure the permit.

"To date, the defendant remains in violation of the Floodplain Regulations despite the county's repeated attempts to achieve compliance," the suit says.

The county asserts that the respondent has remained in violation for more than 500 days.
