Dutch citizen alleges father, business owes broke agreement

HOUSTON — A Netherlands man is suing his father and his business, alleging breach of an agreement.

Cornelius Wijt filed a lawsuit Dec. 27 in the Houston Division of the Southern District of Texas against Tim Wijt of Houston and Creations in Concrete LLC, alleging failure to perform their contractual obligations.

According to the complaint, on June 17, 2013, Cornelius Wijt loaned the defendants $200,000, so that his father, Tim Wijt, could buy out his partner’s share of Creations and become the sole owner. The suit says Cornelius Wijt has received payment for only half of the amount. 

The plaintiff alleges the defendants failed to record the loan on their books, refused to pay the remaining balance of $100,000 or any of the interest and Tim Wijt has failed to designate the plaintiff as the beneficiary of his life insurance policy.

Cornelius Wijt seeks trial by jury, judgment for actual damages of $100,000, plus interest, exemplary damages, attorney fees, court costs and all other equitable relief. He is represented by attorney Dinesh H. Singhal of The Singhal Law Firm in Houston.
