Law money 02

TYLER — A Texas woman has filed a class action lawsuit against Dollar General, alleging breach of contract and violation of applicable minimum wage laws in failing to pay overtime.

Tikki Carroll, individually and on behalf of all others similarly situated, filed a complaint Jan. 5 in the Tyler Division of the Eastern District of Texas against Dollar General Corporation, alleging violation of the Fair Labor Standards Act.

According to the complaint, Carroll routinely worked in excess of 40 hours per week between September 2015 and September 2016 as assistant manager and acting store manager at the Dollar General store in Tyler without receiving proper overtime compensation. The suit says she was paid below the minimum wage in certain weeks in which she worked overtime hours.

The plaintiff alleges Dollar General refused to properly compensate her in violation of FLSA.

Carroll seeks trial by jury, an order requiring Dollar General to pay her unpaid wages, compensatory, liquidated, consequential and incidental damages, litigation costs and all other just and proper relief. She is represented by attorneys Charles W. Branham III and Corinna Chandler of Dean Omar & Branham LLP in Dallas.
