Driver alleges Geico breached contract

BEAUMONT — A Port Arthur man is suing Geico, alleging refusal to apply claims payments.

Baber Naeem filed a complaint Jan. 20 in Jefferson County District Court against Geico Advantage Insurance Company, alleging failure to perform obligations under the terms of the insurance policy.

According to the complaint, on June 28, 2013, in Beaumont, Naeem's vehicle was struck by an under-insured motor vehicle driven by Michelle Wiggins. As a result of the accident, the suit says, Naeem suffered injuries and has incurred medical expenses of $5,000, and of $19,000 for the diminished value of his vehicle. 

The plaintiff alleges Geico continues to refuse to pay Naeem's claim under the policy.

Naeem seeks trial by jury, monetary relief between $100,000 and $500,000, including pre- and post-judgment interest, costs of court and all other relief. He is represented by attorney Tom Oxford of Waldmann Smallwood, PC in Beaumont.
