Wire tying company sues wire product distributors

Wire tying company accuses wire product distributors of trademark infringement

HOUSTON — A wire tying company is suing Pinnacle Wire Group LLC and Pinnacle Wire LLC, wire product distributors, citing alleged trademark infringement.

Accent Packaging Inc. d/b/a Accent Wire-Tie filed a complaint on Jan. 25, in the U.S. District Court for the Southern District of Texas against the defendants alleging that they violated the Lanham Act.

According to the complaint, the plaintiff alleges that, as a result of defendants infringement, plaintiff suffered irreparable injury to its business, including but not limited to loss of profits. The plaintiff holds Pinnacle Wire Group LLC and Pinnacle Wire LLC responsible because the defendants allegedly used plaintiff's registered Pinnacle mark in connection with the marketing of wire-tying products and services and directly marketed their products to plaintiff's customers.

The plaintiff requests a trial by jury and seeks temporary and permanent injunction, disgorgement of defendants’ profits, treble damages, attorneys’ fees and costs and for all other relief to which it may show itself justly entitled.
