Consumer alleges debt collector broke law

HOUSTON — A Rosenberg man is suing a debt collector, alleging abusive and deceptive collection practices.

Lee Rodriguez Hernandez filed a lawsuit Jan. 30, in the Houston Division of the Southern District of Texas against Velocity Investments LLC, alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, on Sept. 8, 2016, Hernandez received a collection letter from Velocity regarding the very same debt that the defendant previously had dismissed. As a result of Velocity's continued collection efforts, the suit says, Hernandez has suffered anxiety, distress and disruption to his daily routine. 

The plaintiff alleges Velocity Investments directly communicated with him while knowing Hernandez was being represented by an attorney and has been unresponsive to all of his requests for validation of the debt.

Hernandez seeks trial by jury, actual and statutory damages, attorney fees and all other just and proper relief. He is represented by attorney Dana Karni of Karni Law Firm PC in Houston.
