Houston business accuses investment company of breach of contract

HOUSTON — A Houston business is suing an investment company, alleging refusal to apply payments.

Hopewell-Pilot Project LLC filed a complaint Feb. 9 in the Houston Division of the Southern District of Texas against EnSource Investments LLC, alleging failure to complete payment as agreed between the parties.

According to the complaint, Hopewell-Pilot was granted a bridge loan by EnSource that was later converted at the defendant's insistence into equity through a subscription agreement and an amended company agreement. 

The suit says EnSource agreed to fund Hopewell-Pilot in three separate installments but the plaintiff has failed to received the final $100,000 payment due Dec. 31, 2016. 

The plaintiff alleges EnSource Investments has failed to perform its contractual obligation by refusing to pay the overdue final installment.

Hopewell-Pilot Project seeks trial by jury, actual damages, attorney fees, pre- and post-judgment interest and all other legal and equitable relief. It is represented by attorney Pete T. Patterson of Patterson PC in Houston.
