Operations manager alleges former employers violated law

HOUSTON — A Houston man is suing his former employers, alleging violation of the Fair Labor Standards Act. 

Johnny B. Marace filed a complaint Feb. 15 in the Houston Division of the Southern District of Texas against Datalog Geological Services LLC, Ernest Fuhrman and James P. Dossey, alleging failure to properly pay the plaintiff.

According to the complaint, Marace worked for defendant as an operations manager between Jan. 1-Jan. 17, 2017, and it was agreed that he was to be compensated $5,000 per month. The suit says Marace did not receive any payment. 

The plaintiff alleges the defendants failed to act reasonably to comply with the FLSA, by not paying Marace for any of his work.

Marace seeks trial by jury, unpaid wages, liquidated damages, reasonable attorney fees and court costs. plus all other equitable relief. He is represented by attorneys Thomas H. Padgett, Jr. of Ross Law Group in Bellaire, and by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
