Potential franchisees accuse spa of breaching settlement

HOUSTON — Potential franchisees are suing spa businesses franchisers, alleging breach of a settlement agreement.

Angela Henry, Jerome Malone, Secured Legacy Franchise Development Inc. and Sagemont Developers Inc. filed a complaint Feb. 16 in the Houston Division of the Southern District of Texas against Spa 810, LLC and John Dunatov, alleging they breached their contractual obligations.

According to the complaint, as a result of the defendants conduct, the plaintiffs have suffered actual damages in an financial amount in excess of the minimum jurisdictional limits of the court. The plaintiffs allege the defendants failed to make timely payments as promised for the development of a spa.

The plaintiffs seek trial by jury, damages of at least $450,000, attorney fees, court costs and interest and all other equitable relief. They are represented by attorney Jeffrey W. Wheelock of Dickinson & Wheelock PC in Houston.
