Woman falls out of wheelchair while waiting for ride, sues Endoscopy Center of SE Texas for $1M

BEAUMONT – The Endoscopy Center of Southeast Texas was recently hit with a medical malpractice lawsuit, sued by a patient claiming she fell out of her wheelchair while waiting for a ride.

Through Mostyn Law attorney Mark Sparks, plaintiff Marianne Wiggins filed suit against The Endoscopy Center on March 1 in Jefferson County District Court, seeking more than $1 million in damages.

According to the petition, on Oct. 26, 2015, Wiggins was under the care of The Endoscopy Center. She was awoken after a colonoscopy, placed in a wheelchair and then rolled out to the rear exit of the building.

Wiggins was told to ring a bell when her ride arrived and was left alone.

“Plaintiff then woke up lying on the floor having fallen out the wheel chair landing on her shoulder,” the suit states. “As a result of (defendant’s) negligence and failures to properly care for plaintiff, plaintiff suffered a head injury and severely injured her shoulder.”

The Endoscopy Center is accused of failing to properly bring Wiggins back from anesthesia and failing to provide her with proper post treatment care.

On top of punitive damages, Wiggins is suing for past and future pain, mental anguish, impairment, disfigurement and lost wages, plus attorney’s fees.

Judge Kent Walston, 58th District Court, has been assigned to the case.
