Couple blames pet owner for dog attack

GALVESTON — A couple is suing a pet owner, alleging her negligence led to a dog attack that injured the plaintiffs' child. 

Lauren Mauck and Bradley Powell, individually and as next friends of John Doe, a minor, filed a complaint Feb. 22 in Galveston County District Court against Holly Day, alleging the pet owner failed to exercise ordinary care in the supervision and/or control of her dog.

According to the complaint, on July 30, 2016, Mauck, Powell, and John Doe, the minor, were in the back yard of a Dickinson home for a social gathering with several other individuals. The suit says suddenly, Day's dog, a pit bull, lunged at and bit John Doe's face/lower chin, requiring immediate medical attention. 

The suit says the plaintiffs suffered emotional injuries as a result of witnessing the vicious attack on their 2-year-old son. The plaintiffs allege Holly Day failed to warn the plaintiffs of her dog’s dangerous and vicious propensities and failed to keep the dog on a leash or in an area where it could not attack visitors.

Mauck and Powell seek trial by jury, and seek monetary relief between $200,000 and $1 million and all other relief. They are represented by attorney Tom Gehring of The Office of Tom Gehring PC in Austin.
