Plumbing problems prompt home buyer lawsuit

GALVESTON — Two home buyers are suing Gregory Scott Dugat and OJK Properties, citing alleged deceptive trade practices in the purchase of a house.

Alan Bunn and Winnifred Bunn filed a complaint on Feb. 23, in the Galveston County District Court against the defendants, alleging that they violated the Texas Deceptive Trade Practices - Consumer Protection Act.

According to the complaint, the plaintiffs allege that they purchased a house with the added assurance that the defendant would be correcting plumbing venting problems. After taking ownership of the home, they discovered that routine use of the plumbing resulted in flooding. As a result, the plaintiffs suffered great expenses in bringing the plumbing up to the city’s requirements and loss of income for having to move a tenant into another property.

The plaintiffs hold Dugat and OJK Properties responsible because the defendants allegedly induced the plaintiffs to enter into the transaction based on concealment or failure to disclose.

The plaintiffs request a trial by jury and seek monetary relief of more than $100,000, but not more than $200,000, and other relief. They are represented by S. Benjamin Shabot of Simpson, Beeton, Shabot & McConnell LLC in Galveston.
