Equipment supplier sues health care provider

GALVESTON — An equipment supplier is suing Onpointe Health Development LLC  a health care provider, citing alleged failure to pay for lost equipment

D&D Medical Equipment Inc. filed a complaint on Feb. 23, in the Galveston County District Court against Onpointe, alleging that the health care provider failed to fulfill its contractual obligations.

According to the complaint, the plaintiff sold and delivered goods, merchandise and services to the defendant at a reasonable price. But the defendant lost some of the equipment, and the cost to replace it was $5,600. The plaintiff holds Onpointe responsible because the defendant allegedly promised to pay for it but failed and refused to do so. 

The plaintiff requests a trial by jury and seeks judgment against defendant for the sum of $17,892, plus interest, attorney fees in the amount of $5,500 and for other relief. It is represented by Russell Ducoff of The Law Offices of Russell C. Ducoff in Houston.
