Houston resident accuses M&J Loan Financial Associates of fraud

HOUSTON — A consumer is suing M&J Loan Financial Associates LLC, a real estate seller, citing alleged misleading and deceptive trade practices.

Bertin Abeja filed a complaint on March 8 in the Harris County District Court against the company, alleging that the real estate seller violated the Texas Business and Commerce Code.

According to the complaint, the plaintiff alleges that M&J agreed to sell property to the plaintiff for $135,839, with a 30-year finance period, on Sept. 1, 2016. The plaintiff paid $12,350 for evaluation, inspection fees and deposit, the complaint said. Abeja later discovered that the defendant was not the real owner of the property, according to the lawsuit. The defendant issued a check for reimbursement, which was later subjected to a stop order, on Nov. 4, 2016.

The plaintiff is asking for damages in the amount of $14,450. The plaintiff holds M&J responsible because the defendant allegedly misrepresented itself as the rightful owner of the property and failed and refused to reimburse plaintiff's deposit.

The plaintiff requests a trial by jury and seeks economic and actual damages, interest, attorney fees, costs and other relief. He is represented by Sandra Gomez of Gomez Law PLLC in Houston.
