Medical care provider sues attorney over failure to pay

HOUSTON — A medical care provider is suing a legal service provider, citing alleged breach of fiduciary duty.

Memorial MRI & Diagnostic LLC filed a complaint on March 8 in the Harris County District Court against Olugboyega Rotimi Areola, alleging that the legal service provider failed to perform his contractual obligations.

According to the complaint, the plaintiff performed medical services for the defendant's clients in order to successfully deal with his clients' personal injury claims. As a result of the defendant's conduct, the plaintiff suffered damages, the complaint said. The plaintiff holds Areola responsible because the defendant allegedly failed to pay his clients' medical bills upon settlement and receipt of the proceeds and misapplied the interest on lawyer trust account proceeds.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, costs of court, attorney fees, interest and other relief. It is represented by Phillip Brantley of Phillip Brantley & Associates P.C. in Houston.
