Employee alleges oil field company failed to pay overtime

HOUSTON — A supervisor has filed a class action lawsuit against an oil field company, alleging violation of workers compensation acts in failing to pay overtime.

Jayson Conway, individually and on behalf of all similarly situated persons filed a complaint March 9 in the Houston Division of the Southern District of Texas against JPH Holdings LLC, doing business as JPH Texas Holdings, and JP Hydro, et al, alleging violation of the Fair Labor Standards Act.

According to the complaint, between 2014 and Nov. 10, 2016, during the times Conway was in the field, and on-site at locations as a supervisor, he often worked in excess of 70 hours per week. The suit says Conway and other employees were paid on a salary basis with a day-rate bonus, but were not paid an overtime premium for hours worked more than 40 a week. 

Conway alleges the defendants failed to comply with the minimum wage or overtime provisions contained within the FLSA.

Conway seeks trial by jury, unpaid overtime wages, pre-judgment interest, all costs, attorney fees and all equitable relief. He is represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of Houston.
