Two construction workers allege former employer failed to pay overtime

HOUSTON — Two construction workers are suing a drywall business, alleging failure to pay overtime in violation of workers compensation acts.

Ambrosio Espinoza and Hugo Roman Barcenas filed a complaint March 20 in the Houston Division of the Southern District of Texas against Whiteroc Drywall LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Espinoza, between 2014 and 2016, and Barcenas, between 2015 and 2016, regularly worked in excess of 40 hours in a week but were not paid any overtime wages for all hours worked over 40 per week. The plaintiffs allege Whiteroc Drywall failed to pay the minimum wage and/or overtime compensation as required by FLSA.

The plaintiffs seek trial by jury, unpaid minimum and overtime wages, liquidated damages , attorney fees and court costs and all other just and equitable relief. They are represented by attorney Josef F. Buenker of The Buenker Law Firm in Houston.
