Truck driver accuses former employer of civil rights violations

MARSHALL — A Howe man is suing a trucking company, alleging disability discrimination.

Jody Wayne Justice filed a complaint March 22 in the Marshall Division of the Eastern District of Texas against Machinery Transport Inc. alleging violation of the Title VII of the Civil Rights Act.

According to the complaint, on Aug. 30, 2016, Wayne was terminated from employment after being treated for a stroke in a New York hospital. As a result of Machinery Transport's discrimination on the basis of disability, Justice has suffered lost wages and benefits and lost employment opportunities. 

The plaintiff alleges Machinery Transport refused to provide reasonable accommodation and terminated him by reason of his actual or perceived disability.

Justice seeks trial by jury, back pay, compensatory and exemplary damages, attorney fees, litigation expenses and costs and all such other proper relief. He is represented by attorney William S. Hommel, Jr. of Hommel Law Firm in Tyler.
