Former tenant blames West Houston apartment complex operators for assault

HOUSTON — A Washington state woman is suing West Houston apartment complex operators, alleging breach of duty in failing to protect her from assault.

Kemilee K. Rainey of King County, Washington, filed a complaint March 30 in Harris County District Court against Berkshire Communities LLC, doing business as Creekstone Apartments and BVF-III Creekstone LLC, alleging violation of the Texas Deceptive Trade Practices-Consumer Protection Act.

According to the complaint, on March 31, 2015, Rainey a former tenant at Creekstone Apartments, sustained significant emotional, traumatic and monetary damages, as a result of an assault and burglary in her apartment unit. The plaintiff alleges the defendants breached their duty to protect her her from unreasonable risk of harm and failed to adopt and implement adequate safety measures to protect residents in their apartments.

Rainey seeks monetary relief between $200,000 and $1 million, pre- and post-judgment interest, court costs and all just and equitable relief. She is represented by attorney Henry D. Drewinko of Houston.
