Motorist alleges GEICO breached contract

GALVESTON — A Galveston County motorist is suing GEICO, alleging breach of an insurance contract.

Josanna Guadalupe Lopez of Dickinson filed a complaint April 5 in Galveston County District Court against GEICO County Mutual Insurance Company, alleging breach of good faith and fair dealing.

According to the complaint, on Oct. 29, 2015, Lopez was traveling east in the 100 block of W FM 517 in Dickinson when a negligent and under-insured motorist failed to yield the right of way and collided with the plaintiff’s vehicle, leading to significant injuries for Lopez. 

Lopez is seeking damages under the under-insured motorist coverage of her insurance policy, however, she alleges GEICO has willfully delayed and denied the plaintiff’s claim.

Lopez seeks trial by jury, monetary relief up to $100,000 and all general and special relief. She is represented by attorney William R. Liles of Jim S. Adler & Associates in Houston.
