Healthcare facility operators sue business partner

GALVESTON — Healthcare facility operators are suing SCTW Health Care Center Inc. and WTCS Health Care Center Inc., business partners, citing alleged breach of agreement.

JVJ Healthcare LLC and Carson Healthcare LLC filed a complaint on April 27, in the Galveston County District Court against the defendants alleging that they failed to perform their obligations under the terms of the contract.

According to the complaint, the plaintiffs allege that, in Dec. 21, 2012, JVJ Healthcare LLC and Carson Healthcare LLC entered into several agreements with defendants involving the operation of two nursing home facilities in Galveston County. As of Nov. 18, 2016 plaintiff are entitled to receive $750,000 under the terms of the agreements and is now seeking the return of the $175,000 original option payment. The plaintiffs holds SCTW Health Care Center Inc. and WTCS Health Care Center Inc. responsible because the defendants allegedly failed to grant plaintiffs share of 25% of the funds that should have been deposited into the Escrow Account and failed to return the original option payment.

The plaintiffs request a trial by jury and seek monetary relief of over $500,000.00, but not more than $1 million and such other just and proper relief. They are represented by Lynn J. Klement of Law Office of Lynn J. Klement in Angleton.
