Tenant blames apartment owner for injuries

HOUSTON — A Harris County man is suing an owner/occupier of a Houston apartment complex, alleging gross negligence in maintaining premises and causing injuries to others.

Daniel Miranda filed a complaint May 24 in Harris County Circuit Court against DTI Investments Inc., alleging failure to exercise ordinary care in keeping a premises safe to avoid having a dangerous condition. 

According to the complaint, on June 26, 2015, while removing trash from the trunk of his car, Miranda tripped on a metal rebar jutting out from concrete in the parking lot area of the Carlyle Place Apartments. The suit says he fell and suffered physical injuries, requiring surgery and medical care. 

The plaintiff alleges DTI Investments failed to promptly repair the premises, failed to maintain the premises and failed to warn others that a dangerous condition existed.

Miranda seeks monetary relief between $200,000 and $1 million, including damages, penalties, court costs, expenses, pre- and post-judgment interest, attorney fees and all other equitable relief. He is represented by attorneys Husein Hadi and Jamil Thomas of The Hadi Law Firm in Houston.
