Harris County resident accuses Dialing Service of invading privacy

HOUSTON — A consumer is suing a New Mexico company and its agent, citing alleged invasion of privacy and violation of telephone harassment statutes.

Joe Shields filed a complaint May 31 in the Houston Division of the Southern District of Texas against Dialing Service LLC and Anthony C. Kolker alleging that they violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that his privacy has been invaded and his limited cellphone data plan has been reduced as a result of the defendants' actions. The plaintiff holds Dialing Service and Kolker responsible because the defendants allegedly made calls to the plaintiff's cellphone without his prior express consent and made calls suing an autodialing machine and a pre-recorded voice message.

The plaintiff requests a trial by jury and seeks actual, statutory and treble damages, costs of theses proceedings and such other just and equitable relief.
