Briarwick Condominium Owners Association accused of negligence after fire on property

HOUSTON — Parents and an estate administrator are suing condominium owners' association and project manager, citing alleged gross negligence.

Lizzi Cherian, Cherian M. Cherian and Susan Cherian Thomas, independent administrator of the estate of Shirley Sara Cherian, deceased filed a complaint June 2 in the Harris County District Court against Briarwick Condominium Owners Association Inc. and Simple Management Solutions, alleging they breached their duty to maintain the condominiums in a reasonably safe condition.

According to the complaint, the plaintiff alleges that on Nov. 29, a fire ignited on the ground floor of the condominiums and spread upward and through the ceiling of Unit #1905, where Shirley Sara Cherian lived. She died in the fire due to thermal and inhalation injuries, the complaint states. The plaintiff holds Briarwick Condominium Owners Association and Simple Management Solutions responsible because the defendants allegedly failed to properly inspect and maintain the common elements of the condominiums and failed to replace and/or repair them.

The plaintiff requests a trial by jury and seeks actual damages between $5 million and $15 million and such other relief to which plaintiff may be entitled. They are represented by Robert E. Lapin of Lapin & Landa LLP in Houston.
