Smith County couple blames truck line for causing crash

MARSHALL — A Smith County couple is suing a truck line owner, alleging its negligence caused a crash that injured the plaintiffs.

Brenton Hill and Trenton Hill Jr. of Tyler, Texas, filed a complaint June 13 in the Marshall Division of the Eastern District of Texas against Pavestone LLC, alleging the defendant's employee failed to act and/or respond in a reasonable manner.

According to the complaint, on Sept. 23, 2016, the Hills sustained personal injuries and property damage due to the negligence of a Pavestone employee, Cary Thomas Yeomans, who crashed his Freightliner truck into the plaintiffs' Lexus on an entrance to Interstate Highway 20. The Hills said they experienced physical pain and suffering, mental anguish, medical and pharmaceutical expenses and physical impairment. 

The plaintiffs allege Pavestone's employee failed to yield the right-of-way, failed to keep a proper lookout and failed to timely apply the brakes.

The Hills seeks trial by jury, damages in excess of $75,000, pre-judgment interest, costs of suit and all other relief. They are represented by J. Chad Parker and Forrest F. Mays of J. Chad Parker PLLC in Tyler.
