HOUSTON – A Harris County woman alleges she was wrongfully terminated because of her disability.
Sarah Boucher filed a complaint on June 23 in the Houston Division of the Southern District of Texas against Higman Marine Services Inc. alleging that the former employer violated the Family and Medical Leave Act.
According to the complaint, the plaintiff requested medical leave in January 2017 from her position with the defendant. The suit states that when her FMLA leave was ending in April, she contacted the defendant asking about a specific return-to-work date and was later terminated.
The plaintiff holds Higman Marine Services Inc. responsible because the defendant allegedly discriminated against her regarding the terms and conditions of employment and retaliated against her by terminating her for requesting protected medical leave.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages, liquidated damages, expert witness fees, court costs, attorney’s fees, pre- and post-judgment interest and such other general and equitable relief.
