Couple accuses timeshare brokers of negligent misrepresentation

GALVESTON — A Katy husband and wife are suing timeshare brokers, alleging negligent misrepresentation.

Vicki Lynn Lewis and William Carter Lewis filed a complaint July 12 in Galveston County District Court against Cindy Estrada, Global/Access Exchange LLC and Orange Lake Country Club Inc., alleging they violated the Texas Deceptive Trade Practices/Consumer Protection Act.

According to the complaint, the Lewises sustained economic and actual damages for the equity down payment of $18,910, plus all closing expenses of $2,910 and for loss of use of the timeshares. The plaintiffs allege the defendants refused to comply with the terms of the agreement of the (90) days cancellation period.

The plaintiffs seek trial by jury, monetary relief between $100,000 and $200,000 and all such other equitable relief. They are represented by Steven M. Smith of Smith & Smith in Houston.
