Lawsuit alleges Bell Co. man shot at hunting preserve, says pellets still stuck in eye

HOUSTON – An alleged accident at a Colorado County hunting preserve is the subject of a Bell County couple’s lawsuit.

Bobby Glen and Donna Whatley are suing Top Flight Hunting Preserve, Inc. on claims the husband was shot during a bird hunt at the defendant’s venue on Dec. 7, 2015.

Recent court papers filed on Oct. 26 in the Harris County 157th District Court explain that Bobby Glen Whatley was part of a hunting party led by guide Sean Kulhanek. Kulhanek reportedly had the group assemble at a bird shooting station without keeping the hunters in proper formation.

After getting the group in place, the guide released his dog to force a bird out of the bush.

The suit asserts one of the men accompanying Bobby Glen Whatley raised his firearm, tracked the bird over the line, and pulled the trigger, which caused multiple pellets to hit Bobby Glenn Whatley in the neck, face, and shoulder.

Per the plaintiffs, the husband has projectiles still lodged behind his eye and surgery would blind him in said eye. The incident ultimately caused Bobby Glen Whatley to suffer from cardiomyopathy.

Kulhanek joins Top Flight as a co-defendant.

The complainants consequently seek unspecified monetary damages and a jury trial.
