S.C.G.C. Inc. alleged to have failed to pay appropriate rate for overtime work

HOUSTON – A man has filed suit against his former employer over allegations that he was paid straight time for overtime work.

Victor Ortega, individually and on behalf of all others similarly situated, filed a complaint on Dec. 19, 2017, in the Houston Division of the Southern District of Texas against S.C.G.C. Inc. and Umer F. Khan alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants from February to October 2017 as a framer. He alleges that he regularly worked 60 hours or more per week but was paid the same hourly rate for all hours worked.

The plaintiff holds S.C.G.C. Inc. and Khan responsible because the defendants allegedly did not make a good faith effort to comply with the FLSA by refusing to pay proper overtime compensation at the rate of one-and-one-half times his regular rate for all hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks unpaid overtime wages at the applicable rate, liquidated damages, prejudgment interest, attorney’s fees, costs and any other just and equitable relief. He is represented by Josef F. Buenker of The Buenker Law Firm in Houston.
