Centerpoint Energy Inc. named in suit by man who hit marker with lawn mower

HOUSTON – A Harris County man alleges he was injured when he struck a marker used to indicate buried utilities with his lawn mower.

Hector Calvo filed a complaint on Jan. 9 in the Harris County District Court against Centerpoint Energy Inc., SER Construction Partners LLC, et al. alleging negligence and other counts.

According to the complaint, the plaintiff alleges that on Feb. 25, 2017, he was injured when his lawn mower struck Centerpoint's steel wire markers installed by SER and abandoned at his residence. He alleges a short portion of the cut steel wire propelled at his chin, penetrated his flesh and rested below his jaw at his throat. He alleges he suffered pain, lost wages, nerve impairment and medical expenses. 

The plaintiff holds Centerpoint Energy Inc., SER Construction Partners LLC, et al. responsible because the defendants allegedly negligently created a dangerous condition by placing steel wire markers in his property and failing to remove the same in a reasonable time.

The plaintiff seeks damages within the jurisdictional limits of the court, pre- and post-judgment interest, costs and such other lawful and equitable relief. He is represented by Mark A. Carrigan and Jon R. Alworth of Carrigan Law Group PC in Houston.
