Homeowners allege Bayou Holdings, SWE Homes failed to co-sign insurance check

HOUSTON – The owners of a Houston home damaged by Hurricane Harvey allege two entities have failed to perform their lender and servicer obligations.

James C. Self and Rosa M. Self filed a complaint on March 20 in the Harris County District Court against Bayou Holdings LP and SWE Homes LP alleging lender liability, violation of the Texas Insurance Code and other counts.

According to the complaint, the plaintiffs allege that in August 2017, their residence suffered extensive damage due to Hurricane Harvey. They allege they submitted a claim to their insurer, which issued a check that required a co-signature of lender Bayou Holdings. The plaintiffs allege they signed the check and delivered it to SWE Homes for Bayou Holdings' signature, but the defendants have failed and refused to sign the check.

The plaintiffs request a trial by jury and seek monetary relief of less than $100,000 and such other relief to which they are entitled. They are represented by K. B. Battaglini and David A. Kirby of Strong Pipkin Bissell & Ledyard LLP in Houston.
