HOUSTON – A Huffman woman alleges she was not paid for all overtime hours worked by her former school district employer.

Donna Payton filed a complaint on Aug. 9 in the Houston Division of the Southern District of Texas against Goose Creek Consolidated Independent School District alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendant as a school resource officer from April 2014 to August 2017. She alleges she was not paid for all overtime hours she worked. She alleges the defendant docked half-hour meal breaks daily when she did not take them.

The plaintiff holds Goose Creek Consolidated Independent School District responsible because the defendant allegedly did not make a good faith effort to comply with the overtime provisions of the FLSA.

The plaintiff requests a trial by jury and seeks all unpaid wages, liquidated damages, attorney’s fees, out-of-pocket expenses and costs and such other and further relief as the court deems just and proper. She is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
