Truck slammed into vehicle and dragged it along highway, suit alleges

HOUSTON – A couple of Texas residents are “fortunate to be alive” following a recent automobile collision on I-45.

Seeking more than $1 million in damages, Dan and Vy Nguyen filed suit against South Houston Carriers and Danial Cruz on Aug. 28 in Harris County District Court.

According to the lawsuit, on Aug. 16 the Nguyens were traveling on I-45 when a commercial truck operated by Cruz slammed into their vehicle on the driver’s side and dragged it along the highway until the truck finally detached.

Defendant South Houston Carriers, a trucking company, owned the truck and entrusted it to Defendant Cruz.

“Plaintiffs are fortunate to be alive,” the suit states. “Defendants failed to ensure the safe operation of the commercial truck, as it entered Plaintiffs’ lane without warning and without ensuring the lane was clear. Defendants’ vehicle wholly failed to maintain a proper lookout on the road. The incident caused serious injury to Plaintiffs. Plaintiffs now bring this lawsuit to recover damages.”

The plaintiffs are suing for their pain, suffering, disfigurement, impairment, medical expenses, mental anguish and loss of earning capacity.
