Houston man files breach of contract claim over $43,000 loan for new business venture

HOUSTON — A man who invested $43,000 in a new business venture that never materialized claims the borrower defaulted on his loan. 

July Canales filed a complaint Feb. 29 in the Harris County District Court against Perla Gutierrez alleging fraudulent inducement and breach of contract. 

Canales borrowed $43,000 from Regions Bank on Feb. 14, 2019, to invest in a new bar being built by Gutierrez. He alleges that per their written agreement, he received three months of payments from Gutierrez, however no work was being done on the construction of the bar. Canales claims Gutierrez stopped paying in June of 2019.

Canales seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Attorney Timothy Henderson in Bellaire, Texas.
