Houston Dairy Queen sues U-Haul driver after truck struck restaurant's roof

HOUSTON — The owner of a South Houston Dairy Queen is suing the driver of a rented U-Haul truck it claims struck the roof of the restaurant and caused significant damage. 

Pooya Enterprises Inc., filed a complaint July 16 in Harris County District Court against Quinten Robertson alleging breach of duty. 

According to the complaint, Robertson was driving a rented U-Haul truck to the plaintiff's Dairy Queen Restaurant in East Houston on Jan. 23.  Robertson hit the "lower roof" of the Dairy Queen with the truck and caused "substantial damage" to the restaurant's roof, the suit alleges.

It claims Robertson should have realized the roof of the Dairy Queen was lower than the top of his U-Haul truck and should not have attempted to drive under the patio overhang of the restaurant. Pooya also claims Robertson had a duty to not drive his U-Haul truck too close to the restaurant. The plaintiff claims Robertson's U-Haul caused "substantial damage and a huge expense to repair." Pooya also claims  despite Robertson promising to compensate the company for the damages, he has not paid for the repairs. 

Pooya seeks monetary relief of $50,000 or less, interest and all other just relief. It is represented by Attorney Edward Rose Jr., in League City.
