Texas justices affirm dismissal of age discrimination suit against Office of the Attorney General

HOUSTON – The First Court of Appeals recently affirmed the dismissal of an age discrimination lawsuit brought against the Office of the Attorney General.

Kim Coogan brought the suit under the Texas Commission on Human Rights Act. The OAG filed a plea to the jurisdiction based on the statute of limitations, which the trial court granted.

Coogan appealed and on Dec. 8 the First Court found the trial court did not err, finding her TCHRA claims are barred by sovereign immunity.

“Because Coogan’s failure to timely file her age discrimination lawsuit deprived the trial court of subject-matter jurisdiction over her claims, we affirm the trial court’s order granting the OAG’s plea to the jurisdiction,” the opinion states.

Coogan worked the OAG for 19 years as an assistant attorney general in the Law Enforcement Division.

She asserts she was passed over for promotion and told she could either resign or be terminated.
