Woman allegedly slips on waxy floor at Saks Fifth Avenue, sues for $250K

HOUSTON — A woman is alleging she slipped on a "waxy/greasy" substance that was on the floor of a Saks Fifth Avenue store in Cypress and suffered serious injuries. 

Carolyn Towner filed a complaint March 22 in Harris County District Court against Saks & Company LLC doing business as Saks Fifth Avenue/Off 5th alleging premises liability and negligence. 

According to her complaint, Towner was shopping at the Saks Fifth Avenue store on Hempstead Road in Cypress on May 28, 2020. She alleges that while shopping in the shoe department of the store, she slipped and fell on "a waxy/greasy substance" that was on the floor and suffered injuries to her back, neck, forearm, shoulder, hip, ankle and other parts of her body. 

Towner claims there were no warning signs or "other signs of caution" in the area and that Saks Fifth Avenue failed to maintain their premises in a "reasonably safe condition." She also claims Saks Fifth Avenue failed to properly train, supervise and manage its employees who were in charge of the walkways and isles in the store. 

Towner seeks $250,000 or less, interest, trial by jury and all other just relief. She is represented by Attorney Jennie Hovell-Cox in Sugar Land.
