Drunk driver doing donuts in Bombshells parking lot struck pedestrians, $1M suit alleges

HOUSTON — Pedestrians who were struck by a drunk driver while walking through the parking lot of a Houston restaurant and bar are alleging the negligence of the intoxicated driver and the bar that served him the alcohol. 

Barbara Pina, Yessica Barcenas, Mario Rubalcaba and Tony Diaz filed a complaint Aug. 10 in Harris County District Court against RCI Hospitality Holdings Inc., doing business as Bombshells Restaurant & Bar, BMB Dining Services (290) Inc., doing business as Bombshells Restaurant & Bar and Luis Javier Soto, Jr., alleging negligence. 

According to the plaintiffs' complaint, they were leaving the Bombshells Restaurant and Bar on Northwest Freeway in Houston on Nov. 17, 2019. They allege that as they walked through the parking lot, Soto, who was intoxicated, was speeding, spinning his tires and doing donuts in the parking lot, struck them with his vehicle and then fled the scene. 

The plaintiffs claim they suffered serious bodily injuries and allege the negligence of Bombshells for serving Soto alcohol in excess when he was intoxicated and failing to adequately train its employees. 

The plaintiffs allege Soto's negligence for driving while intoxicated, speeding and failing to keep a proper lookout or maintain a single lane of traffic.  

The plaintiffs seek monetary relief of between $250,000 and $1 million, interest and all other just relief. They are represented by Wade Moriarty of Crim & Villalpando PC in Houston.
