Family alleges lack of sedation, restraints caused patient to pull out breathing tube during MRI

HOUSTON — HCA Houston is facing a suit alleging their failure to use  sedation and restraints during an MRI caused a patient to remove her breathing tube and suffer permanent neurological damage. 

Robert Flores and Deonna Flores, individually and as representative and guardians of Kelly Flores and A.F., a minor filed a complaint Sept. 13 in Harris County District Court against HCA Houston Healthcare Clear Lake Hospital, Lisa Nassif Wright, M.D., Imoigele Aisiku, M.D., Christoper Burnette, D.O., Raka Amin, M.D., and others alleging negligence. 

According to the plaintiffs' complaint Kelly Flores, who was 31 years old at the time was taken by ambulance to HCA after being found unresponsive on Sept. 13, 2019, due to an overdose of amphetamines and benzodiazepines. They allege that on Sept. 14, 2019, Flores began to show signs of improvement and was given a second MRI. 

The plaintiffs further allege that Flores, who had a tube down her throat, was agitated during the MRI and at some point during the MRI, removed the tube which was her only source of oxygen. They claim Flores suffered a permanent hypoxic-brain injury that could have been prevented through pre-MRI sedation and soft restraints. The plaintiffs allege that Flores requires a tracheostomy, assistance going to the bathroom, can not speak and requires around the clock care. 

The plaintiffs seek more than $1 million, interest, trial by jury and all other just relief. They are represented by Randall Sorrels and Sara Hashmi of Sorrels Law in Houston.
