$1M suit: Worker falls from warehouse ceiling, shatters legs and skull

HOUSTON — A worker who fell from a warehouse ceiling and shattered his legs and skull is claiming negligence. 

Kenny Roswurm filed a complaint Sept. 30 in Harris County District Court against AGH Machine Inc., Jumpstar Enterprises LLC and Gullermo Alanis alleging negligence. 

According to his complaint, Roswurm was working for Jumpstar as an independent contractor on March 8, 2021, and was assisting with the removal of 240v power cords from AGH's warehouse. 

He claims he was raised by a forklift into the warehouse ceiling to remove the cords when he fell and "was nearly killed." Roswurm claims the fall shattered his legs and skull and caused him to require emergency surgery, months in the hospital as well as rehabilitation to learn to walk again. 

He alleges the defendants' negligence for failing to inspect the premises and correct the dangerous condition and for their failure to adhere to compliance codes and standards. Roswurm futher alleges the defendants failed to warn of the danger, failed to make the exposed power cords reasonably safe or to enforce safety measures and protocols.  

Roswurm seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Joshua Lee and C.J. Baker of Armstrong & Lee LLP in Houston.
