Bicyclist struck by utility vehicle on bike path at Houston's Memorial Park Conservancy, $1M suit alleges

HOUSTON — A bicyclist who was struck by a utility vehicle that was driving on the bike path at Memorial Park Conservancy is claiming negligence. 

Michael Youssefi filed a complaint Nov. 10 in Harris County District Court against Memorial Park Conservancy Inc., alleging negligence. 

According to his complaint, the plaintiff was riding his bicycle with his girlfriend on the TX DOT hike bike path in Memorial Park Conservancy near Woodway Drive and I-610. He alleges that an employee of Memorial Park, Jimmie Cummings, was driving a Kubota utility vehicle on the DOT hike and bike trail and not in a vehicle lane. 

Youssefi claims that Cummings ran into him head-on which caused his bike's front wheel to fold under the impact and caused him to be thrown over his handlebars into the utility vehicle and onto the ground. He further claims he suffered injuries to his knee, ankle, neck mid and lower back. 

Youssefi alleges Cummings failed to keep a proper lookout, failed to control his speed and failed to stop in time to avoid hitting his bike. 

Youssefi seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Joseph Schreiber and Erik Knockaert of The Law Done Right Schreiber/Knockaert PLLC in Houston.
