Food Town employee alleges co-worker purposely led her to area with spill on floor, caused her fall

HOUSTON — A Food Town employee alleges a co-worker purposely called her over to an area where a spill was on the floor which caused her to suffer serious injuries. 

Esmeralda D. Gonzalez filed a complaint Nov. 8 in Harris County District Court against Lewis Food Town Inc., alleging negligence. 

Gonzalez alleges in her complaint that while working as a bagger at the Food Town store on Wilcrest Drive in Houston on March 27, 2020, she suffered an on-the-job injury. Specifically, she claims while walking towards the time clock, a co-worker asked her to come over and as she approached the co-worker, she slipped on a clear cleaning solution. 

She alleges that the younger employees at Food Town treated her badly and that the co-worker knew the spill was there and that her fall caused her to hit the ground and suffer serious injuries. 

Gonzalez alleges Food Town's negligence for failing to warn of the dangerous condition on the floor, failing to provide a safe workplace and failing to have adequate training and supervision for its employees. 

Gonzales seeks monetary relief between $250,000 and $1 million and all other just relief. She is represented by Nichole Nech of Miller Law LLP in Houston.
