Daly & Black sues over alleged tacked on fee on appraisal invoices

HOUSTON - Daly & Black, a Houston law firm specializing in insurance litigation, recently filed a lawsuit seeking more than $1 million in damages. 

Court records show Daly & Black filed suit against Joshua Crescenzi and Estimators, LLC, on Jan. 13 in Harris County District Court. 

According to the lawsuit, Daly & Black has been hiring an appraiser by the name of Bobby Crowson for years. Crowson agreed to charge the firm an hourly rate. The owners and employees of the firm thought Crowson was an owner of Estimators. 

Accordingly, when Crowson performed an appraisal and an invoice was submitted by Estimators, Daly & Black’s accounting department paid the invoices, the suit states. 

“It turns out that not only was Mr. Crowson not an owner of Estimators, LLC, he is not even an employee,” the suit states. “No one at D&B has ever contracted with or spoken to anyone at Estimators, LLC about doing appraisals.

“Crescenzi and Estimators, LLC knew that it had no agreement with D&B to take Bobby Crowson’s invoices, tack on 40% and seek payment from D&B." 

Attorney Richard Daly is representing his firm.
