Former Union Pacific Railroad worker alleges 'runaway' locomotive caused his injuries

HOUSTON — A former Union Pacific Railway worker alleges a "runaway" locomotive caused him to suffer injuries. 

Andrew McNew filed a complaint June 19 in Harris County District Court against Union Pacific Railroad alleging negligence. 

According to his compliant, McNew was working as an electrician for Union Pacific at its Settegast Yard in Houston. He claims that on Sept. 29, 2021, the locomotive he was working on began to start moving down the track and that despite his repeated attempts to apply the emergency brake, the locomotive would not stop. McNew claims that while trying to apply the emergency brake, his suffered a tear to his knee which required surgery to repair. 

He alleges as a result of his injury, he suffers from Post Traumatic Stress Disorder and has been unable to return to work for any railroad or industrial work. McNew claims Union Pacific violated the Federal Employers' Liability Act by failing to maintain a safe workplace for its employees. He also claims Union Pacific failed to warn of the hazardous conditions or comply with the company's safety rules and standards and operating code.  

McNew seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Kevin Camp and John Roven of Roven Camp PLLC in Houston.
