Suit alleges tenant injured while maintenance crews attempted to fix AC unit

HOUSTON — A tenant is claiming negligence after a metal panel dropped on her head while maintenance crews were attempting to fix the AC unit in her apartment. 

Mary Maxine Moss filed a complaint June 28 in Harris County District Court against Lurin Real Estate Holdings XXI LLC doing business as Latitude 2976 Apartments and others alleging premises liability, negligence and other claims. 

According to her complaint, Moss was a tenant at the defendant's apartment in Houston. She claims that she placed a maintenance request for a water leak coming from the AC unit inside her apartment. Moss alleges on July 2, 2021, while doing her laundry, a metal panel above the double sink vanity dropped on her head while maintenance was assessing the leak. 

She claims she was taken by ambulance to the hospital, and when she returned to her apartment at 3 a.m., the AC was still not working and was not fixed until nearly four days later. Moss alleges the defendants' negligence for failing to keep the premises in a safe condition, and failing to properly secure the work area in her apartment. 

Moss seeks monetary relief, interest and all other just relief. She is represented by Willie Powells III of The Law Offices of Willie D. Powells III and Associates PLLC in Houston.
