Shopper sues Lewis Food Town after shopping cart mishap allegedly leaves her injured

A shopper is suing the Lewis Food Town grocery store in Houston, claiming that she fell and injured herself when a wheel came off her shopping cart.

Plaintiff Juana M. Veronica Torres Lucio filed the lawsuit in the Harris County District Court against Lewis Food Town, Inc., citing negligence.

According to the lawsuit, on July 18, 2022, Lucio was a patron of the Lewis Food Town grocery store in Houston. She claims that while she was shopping, the wheels on her shopping cart fell off which caused her to lose her balance and fall, severely injuring herself.

According to the Lucio, the defendant has a responsibility to maintain the premises to protect the safety of its customers and should have been aware of the hazardous condition of the defective shopping cart. Despite this, the defendant negligently failed to maintain the carts to protect the safety of its customers and let a hazardous condition exist at risk to customers.

Lucio claims to have sustained bodily injuries which have caused her to experience pain, suffering, physical impairment, disfigurement, lost wages and mental anguish. She says that her injuries will affect her ability to earn income and lead a normal life. She adds that she has incurred medical expenses and will continue to require the services of medical staff to recover from her injuries

The plaintiff is seeking damages in excess of $250,000, plus interest, court costs and any other relief the court deems proper. She is represented in this case by attorneys Stephen R. Ricks and Javier Marcos, Jr. of the Law Offices of Marcos & Associates, P.C. in Houston.
