Patrick Bonorden sues Positive Recovery Center for injuries suffered on an uneven makeshift sport court

In the District Court of Harris County, Texas, plaintiffs Patrick Bonorden and Kathryn Bonorden have filed a lawsuit against defendants Positive Recovery Center, LLC, Phoenix Multisport, Inc., and EllaG, LLC. The case ID is 2024-23277 and it was filed on April 11, 2024.

The plaintiffs are residents of Houston, Harris County, Texas. They allege that on April 13, 2022, Patrick was an invitee at Positive Recovery Center which is a chemical dependency treatment facility licensed by the Texas Department of Health and Human Services. The premises are owned by defendant EllaG. The plaintiffs further allege that Phoenix Multisport does business in Texas providing addiction recovery through sport.

According to the court filing, while Patrick was at Positive Recovery Center on April 13, 2022, a man who appeared to be a representative of Phoenix Multisport insisted that he go outside to an uneven asphalt driveway area serving as a makeshift sport court to participate in either pickleball or basketball. Despite his reluctance to participate due to the condition of the makeshift court, Patrick felt pressured to comply.

The plaintiffs are seeking damages within the jurisdictional limits of the court for injuries suffered as a result of participating in sports activities on the uneven asphalt driveway. They argue that all conditions precedent have occurred and nothing they did contributed to this occurrence.
